CEQA

The California Environmental Quality Act, a state law requiring government agencies to evaluate and disclose the environmental impacts of proposed projects before approving them, and to mitigate significant impacts where feasible.

What is CEQA?

The California Environmental Quality Act (CEQA) is a state statute that requires public agencies to identify and evaluate the significant environmental effects of proposed "projects" before approving them. CEQA applies to a wide range of government actions, including discretionary permits, zoning changes, general plan amendments, and public works projects. It is one of the most consequential environmental laws in the United States and a defining feature of the California development process.

How CEQA Works

When a project is proposed, the lead agency first determines whether CEQA applies. If it does, the agency evaluates whether the project may have significant environmental effects. If there is no possibility of significant impacts, the project is exempt. If impacts are possible but can be mitigated, a Mitigated Negative Declaration (MND) is prepared. If the project may cause significant unavoidable impacts, a full Environmental Impact Report (EIR) is required.

CEQA and Development Timelines

CEQA review can add significant time to the development process. A categorical exemption may be documented in weeks, an MND typically takes 3-6 months, and an EIR can take 12-24 months or more. CEQA also creates litigation risk — opponents can file legal challenges alleging inadequate environmental review, which can delay projects by years. CEQA reform has been an ongoing legislative topic in California.

CEQA Exemptions

Not all projects require CEQA review. Categorical exemptions cover classes of projects that have been determined not to have significant effects (such as minor alterations to existing buildings). Statutory exemptions exclude specific types of projects (such as certain affordable housing projects under recent legislation). Ministerial approvals are also exempt from CEQA.
