What Is Zoning Compliance Review?
Zoning compliance review is the process where local zoning or planning staff evaluate a proposed project to confirm it complies with all applicable zoning regulations. This review typically happens early in the permitting process — often before or in parallel with building plan review. The reviewer checks whether the proposed use is permitted in the zoning district, and whether the project meets dimensional and development standards like setbacks, height limits, lot coverage, floor area ratio (FAR), parking, signage, and landscaping requirements.
What Gets Checked
Zoning staff review the project against the zoning ordinance for: permitted use (is this type of business or building allowed in this zoning district?), dimensional standards (setbacks, building height, lot coverage, FAR), parking and loading requirements (number of spaces, dimensions, accessibility), signage (size, type, placement, illumination), landscaping and screening requirements, open space and common area requirements, and any applicable overlay district or specific plan standards.
Zoning Clearance vs. Zoning Variance
If a project meets all zoning standards, it receives zoning clearance — essentially a green light that allows the building permit review to proceed. If a project cannot meet one or more zoning requirements, the applicant must either redesign the project to comply or apply for a variance, conditional use permit, or other discretionary approval, which requires a separate application and public hearing process and can add months to the timeline.
Typical Timeline
Zoning compliance review typically takes 1 to 4 weeks when a project conforms to zoning requirements. Simple projects in clear-cut zoning situations may be reviewed in a few days. More complex projects with multiple zoning standards to verify, or projects in areas with overlay districts and specific plans, may take 2-4 weeks. If zoning issues are identified that require redesign or a separate approval, the timeline extends significantly.
